WATCH OUT!!! FHP announces checkpoints to begin

The Florida Highway Patrol (“FHP”) recently announced that they will begin two (2) types of checkpoints. They will conduct either “Drivers License” or “Vehicle Safety Inspections” checkpoints. Pursuant to their policy (FHP Policy 17.07, attached at the bottom of this post) Troopers are authorized to conduct EITHER a Drivers license checkpoint OR a Vehicle Safety Inspection Checkpoint, not both and certainly not a combination of the two. The policy indicates that if FHP is conducting a Drivers License Checkpoint, they may ask for the following:

  1. Valid Drivers Licenses; and
  2. Vehicle Registration; and
  3. Valid proof of Personal Injury Protection (PIP) Insurance

They are not to exceed the scope of requesting these items. This means that any questions asked of you, other than to provide these items will exceed the scope of the checkpoint. If the FHP conducts the Vehicle Safety Inspection Checkpoint, the scope of the inspection is limited to the following items:

  • Horn
  • Windshield Wipers
  • Brakes
  • Tail Lamps
  • Directional Signals (turn signals)
  • Break lights
  • License plate lamp (tag light)
  • Headlights
  • Steering mechanism
  • Tires
  • Exhaust System
  • Other READILY visible equipment

They are prohibited, under their policy, from asking for drivers license or any other information from the driver during the Vehicle Safety Inspection Checkpoint. Both of these checkpoints are only to be conducted during the daytime and are not approved to be conducted during the night. The announced target areas for these checkpoints throughout Hillsborough, Pinellas, Pasco and Hernando counties are statistically strong areas where there are greater amount of individuals with insurance cancellations, driving while suspended charges or other violations.

In addition, if the Troopers have an articuable suspicion of an impaired driver, they can investigate the possibility of a DUI . If you utilize your RIGHT TO REMAIN SILENT and hand the Troopers our business card with your drivers license, registration and insurance you will be well on your way to prevent the Troopers from violating your rights and conducting a non-consensual encounter. You do not have to answer ANY questions, let alone any incriminating questions such as: where you were coming from?, where you were going?, or how much you have had to drink?. Every defense Attorney knows that law enforcement use checkpoints as a means to trap motorists into admissions against their best interest and ultimately arrest or considerable headaches.
